Partner Visas

Partner visas are for married partners and de facto partners of both opposite and the same sexes and for those intending to get married.

There are two partner visas – Offshore and Onshore and there is a Prospective Marriage visa for those intending to wed.

In all instances, the applicant must be sponsored by an Australian citizen, or permanent resident.

There are these three major partner visa subclasses and partners are granted a temporary visa after the  initial process. Then later, a permanent visa may be granted following an eligibility period. if there is a long-standing relationship or children of the relationship, then the permanent visa may be granted more quickly.

Partner Visas Onshore

If you are in Australia, you are eligible to apply for  a Subclass 820 and Permanent visa subclass 801. 

Then if the relationship is genuine and continuing two years after the application was lodged then you can be granted a permanent visa.

Partner Visas Offshore

If you are outside Australia you are eligible to apply for the Subclass 309

followed by the Permanent Subclass 100 if your application is successful

Prospective Marriage Visa 300

To apply for this visa, you must be outside Australia and your fiance must be an Australian citizen,

After arriving in Australia, the applicant has nine months in which to marry their fiance.

Once married, holders of this visa can then apply for a Partner 820/801 visa to remain permanently in Australia.

Partner Visas – Complex

 Requirements

You must be sponsored by a person who is an Australian citizen, Australian permanent resident or eligible New Zealand citizen.

If you have dependent children or other dependent family members, they may make combined applications with your application provided that they meet certain requirement

Partner visas if your visa was refused or cancelled.

Partner visas also may be one of only a couple of available visa options if your visa has been refused or cancelled since your last visit to Australia.

After that, you may still  be  able to apply for a Partner visa in Australia if you meet certain criteria including:

  • You must not have had a partner visa refused since you last entered Australia
  • You must not have had a visa refused or cancelled on character grounds
  • Your application must have  two statutory declarations from Australian citizens, Australian permanent residents or eligible New Zealand citizens  supporting your relationship with your partner.
